As part of a divorce proceeding, the family court will make determinations as to which parent will have custody of the children. The norm in Texas is that both parents are named joint conservators of the children. However, the name is misleading. While both parents will have certain rights and duties such as the right to school information, medical information, etc. one parent is considered the primary parent and will have the children the majority of the time. The other parent will generally have visitation under what is referred to as the "Standard Possession Schedule." The Standard Possession Schedule allows the other parent possession on the first, third and fifth weekends of the month and splits up summer and holiday access. Most custody arguments start off with temporary orders hearings to determine the rights of the parents while a social study is being done to determine what is in the best interest of the children. It is a mistake to go to any such hearing without a good attorney. The Court's first determination may end up determining who ends up with final possession because of the way the system works. Hire a good attorney. Your children are at stake! I should add that too many people believe that in any fight for custody of the children the mother is going to win. That is not the case in Texas today.
