The range of punishment for any crime varies depending on the seriousness of the crime. The range of punishment is shown below. However, it should be noted that the fine and the length of punishment can be increased based on the district attorney requesting that the punishment be increased due to prior offenses. MISDEMEANORS
CLASS A: Up to 1 year in county jail and/or fine up to $4,000
CLASS B: Up to 180 days in county jail and/or a fine up to $2,000
CLASS C: Fine not to exceed $500
FELONIES
CAPITAL: Death by lethal Injection or life imprisonment
FIRST DEGREE: 5 to 99 years or life imprisonment may also be fined up to $10,000
SECOND DEGREE: 2 to 20 years imprisonment may also be fined up to $10,000
THIRD DEGREE: 2 to 10 years imprisonment may also be fined up to $10,000
STATE JAIL: 180 days to 2 years in state jail, may also be fined up to $10,000
