Theft and property crimes include anything from a shoplifting charge for failure to pay at a department store to an extensive and complicated scheme to defraud, which may wind up in state or federal court.
A shoplifting accusation usually occurs after a person has left a store, but there are exceptions. The State must prove that the person was intent on stealing in order to obtain a conviction. “Intent” is usually shown at trial by evidence that the accused tired to hide merchandise on her person or concealed in some way her failure to pay. Often, a client has put some items under his or her cart or baby carriage and left without remembering to pay. In some cases, a child faces juvenile charges fter innocently carrying an item out of a store.
Sometimes an employee is charged with a crime that he has had nothing to do with. Sometimes he was just at the wrong place, at the wrong time. (1) Theft: A Felony offense under Penal Code Section 31.03 (Theft) or 31.04 (Theft of Service), except when the property involved is a motor vehicle; an offense under Section 31.05 (Theft of Trade Secrets); or an offense under Section 32.31 (Credit Card Abuse)
(2) Automobile Theft: A felony offense under Penal Code Section 31.03 (Theft) is the property involved is a motor vehicle, or an offense under Section 31.07 (Unauthorized Use of Vehicle)
